Competitions and Prize Draws – Terms and Conditions

These terms and conditions (“Terms and Conditions”) are applicable to anyone entering the Rigrun Event (the “Event”) promoted by Rigrun Limited, 75 Stanley Street, Aberdeen, Scotland, AB10 6UT (“Rigrun”). By entering the Event, you (“You” or “Entrants”) accept these Terms and Conditions and agree to be bound by them. If You do not accept the Terms and Conditions, You should not enter the Event. To the extent that there is a conflict between these Terms and Conditions and any terms and conditions on the relevant page on Rigrun’s mobile application (the “App”), the terms and conditions on the relevant page on the App shall take precedence.

1. Eligibility

No purchase is necessary to participate in the Event. The Event is open to all personnel of a sponsoring company who are at least eighteen (18) years of age. The Event is not open to directors, officers, agents, contractors and employees of Rigrun, or any of its affiliated or associated entities or divisions, their advertising and promotional agencies or members of the aforementioned individuals’ respective immediate families living in the same household. By entering the Event, You confirm that You are eligible to enter the Event and claim a prize.

2. Eligibility checks

Rigrun reserves the right to verify the eligibility of Entrants. Rigrun may require such information as it considers reasonably necessary for this purpose. By entering the Event, You give Rigrun permission to contact your employer to verify your eligibility. A prize may be withheld unless and until Rigrun is satisfied with the verification.

3. How to enter

At Rigrun’s sole discretion, Rigrun shall hold one or more Events at intervals of Rigrun’s choosing. The qualifying period (i.e., the opening and closing dates) for each Event (the “Qualifying Period”) shall be specified by Rigrun.

To enter an Event, you must:

a) Download the App and sign-up as a user (as part of signing-up as a user you will be required to accept and be bound by the Terms of Use applicable to the use of the App (available here: [·])).

b) Provide the unique access code provided to You by [your sponsoring company/Rigrun];

c) Participate in certain ‘challenges’ specified by Rigrun within the relevant Qualifying Period (the “Challenges”) and record your activity within the App or by logging in to Rigrun’s website.

Entrants to the Event who validly complete a Challenge will be eligible to receive a prize for the completion of that Challenge, as specified by Rigrun. Prizes for certain Challenges may be subject to availability.

Entrants to the Event who complete certain Challenges will be automatically entered into a prize draw to win a further prize, as specified by Rigrun. If you do not wish to be entered into the prize draw, please contact Rigrun at [·].

4. Selection of winner

The nature of the Challenges set for You, and the prizes offered during each prize draw, are selected at Rigrun’s sole discretion. Rigrun shall be under no obligation to offer a minimum number of prizes, or prizes equating to a minimum combined value, for any individual prize draw or Challenge. A maximum of one prize type or prize category may be won by any individual entrant during the entire Event.

One winner will be randomly selected by Rigrun for each prize in a prize draw from all Entrants who have validly completed certain Challenges during the Qualifying Period. The draw will take place within 7 days of end of the Qualifying Period.

All prize draws will be carried out either (i) by an independent person, (ii) under the supervision of an independent person, or (iii) via use of an impartial third-party software designed to fairly select winners at random.

5. Contacting the winner

If You win a prize, You will be notified on the App within 7 days (a “Winner’s Notification”). [After receiving a Winner’s Notification, you must prove your eligibility within 14 days (by, for example, providing any additional information required by Rigrun for the purposes of identification verification and delivery of prize) (the “Eligibility Process”)].

If You do not respond to a Winner’s Notification within 14 days, Rigrun will make two further attempts to contact you via email. If, following these two emails, you have not responded to Rigrun within 21 days of the original Winner’s Notificatoin, Rigrun reserves the right to refuse to award you the relevant prize and instead award it to an alternative winner selected in the same manner described in Section 4 above (who, in turn, will also receive a Winner’s Notification and be obliged to prove their eligibility within a period specified by Rigrun).

[Upon completion of the Eligibility Process], You will be notified [via the App / by phone or email] within 28 days of [completion of the Eligibility Process / receipt of a Winner’s Notification] of how to collect your prize. If it is not possible for You to collect your prize, Rigrun may (at its sole discretion) arrange a date for delivery of the relevant prize to You (the “Delivery Date”). If, for whatever reason, the prize is not delivered to You as arranged, you must notify Rigrun of the delivery failure within 28 days of the Delivery Date in order to rearrange delivery. In the event that you do not notify Rigrun of a delivery failure within 28 days of the Delivery Date, Rigrun retains the right to not reissue the prize to you or to change the value of the prize at Rigrun’s sole discretion.

6. Winner announcement

Rigrun has the right to (i) publish or make available to the public information indicating that a prize has been validly awarded to an individual winner, and (ii) expect each winner to participate in any publicity for the Event. If you are selected as a winner but you object to your information being made available to the public, or if you do not agree to participate in publicity for the Event, you must inform Rigrun of this before accepting your prize.

7. Personal data

If you enter the Event in accordance with Section 2 above, Rigrun will use your personal data to administer your participation in the Event and as otherwise set out in the Rigrun Privacy Policy. The Rigrun Privacy Policy can be found at the following link: https://www.rigrun.co.uk/privacy-policy/

8. Limitation of liability

Rigrun (including their employees and affiliates) will not in any circumstances be responsible or liable to compensate any person for any loss or damage occurring in connection with the Event, Your use of the App or as a result of taking up, receiving or using a prize, except where it is caused by the negligence of Rigrun or their agents, distributors or employees, or where it cannot be excluded by the law (including liability for fraud or death or personal injury arising from negligence).

Any prizes sent to you via post are at your risk, and Rigrun cannot be held responsible for any prizes not received by you. All prizes issued to you are expressly subject to any applicable terms and conditions or requirements of use which accompany the prize.

Rigrun is not responsible or liable for:

a) any entry which, due to a technical fault, is not received by Rigrun within the relevant Qualifying Period; or

b) any external factors that may restrict a winner from accepting their prize; or

c) any winners that cannot be contacted by Rigrun due to the entrant’s email address and/or telephone number being invalid, inactive, incorrect, out of use, blocked, unanswered or otherwise inaccessible to Rigrun (it is your sole responsibility to ensure that you provide accurate contact information to Rigrun).

9. Prizes

Each prize is not exchangeable or transferable and cannot be redeemed for any monetary value. Rigrun reserves the right to award alternative prizes of equal or greater value, should the advertised prize become unavailable for any reason.

10. Fair play

Rigrun retains the right, in its sole discretion, to withhold prizes, or to suspend, cancel, or modify the Event, without liability, if, in its view, the Event has been affected by any instance of tampering, fraud, technical issues, ‘brute force’ methods, use of alias identities, or any other issues or causes beyond the control of Rigrun and/or which compromise the validity of the Event. Rigrun also retains the right, in its sole discretion, to invalidate and/or exclude any entries which it deems to be ineligible, invalid, compromised by any of the issues or causes identified above, or otherwise non-compliant with these Terms and Conditions or the spirit of the Event.

11. Severance

If any provision of these Terms and Conditions is found by any court or administrative body of competent jurisdiction to be invalid, unenforceable or illegal, the other provisions shall remain in force. If any invalid, unenforceable or illegal provision would be valid, enforceable or legal if some part of it were deleted, the provision shall apply with whatever modification is necessary to give effect to the commercial intention of the parties.

12. Rights of third parties

Nothing in these terms and conditions is intended to confer on any person any right to enforce any provision of these terms and conditions which that person would not have had but for the Contract (Third Party Rights) (Scotland) Act 2017.

13. Governing law

These Terms and Conditions are governed by the laws of Scotland and you can bring legal proceedings in respect of the Event in the Scottish courts. If you live in England, you can bring legal proceedings in respect of the Event in either the English or the Scottish courts. If you live in Northern Ireland, you can bring legal proceedings in respect of the Event in either the Northern Irish or the Scottish courts.
